Lawyer claims murder-kidnap case should have been moved

Kirk Levin, 21, of Early is seeking a retrial after being found guilty in June for first-degree murder in the death of his mother Marilyn Schmitt and the third-degree kidnapping of Jessica Vega.

Levin’s attorney Charles Kenville says his case should have been moved to another county and that inadmissible evidence was allowed at his trial.
